KymaCommonsHub offers exclusive yacht charter services, which include, but are not limited to:

  • Corporate retreats
  • Private events
  • Multi-day charters

All services are contingent on availability and climatic conditions. We retain the authority to alter or cease services without prior notice.

3. Booking and Reservations

3.1 Booking Process

To reserve a charter, you are required to:

  • Be at least 18 years old
  • Submit precise and complete information
  • Provide the necessary deposit as detailed in the booking confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

A booking is considered confirmed once payment is received along with our written confirmation. We have the authority to decline service to anyone at our discretion.

3.3 Availability

Charter availability hinges on the vessel and suitable weather conditions. We will exert reasonable efforts to accommodate your chosen dates and times.

4. Payment Terms

4.1 Pricing

All prices are given in € and encompass the relevant taxes unless stated otherwise. Prices are amendable without prior notice.

4.2 Payment Schedule

  • Deposit: 50% of the full charter price required at the time of reservation
  • Balance: Must be settled 48 hours prior to the charter start
  • Supplementary charges (if applicable): Payable upon charter completion

4.3 Payment Methods

We accept key credit cards, bank wire transfers, and certified cheques. Secure and encrypted methods are employed for payment processing.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • Over 72 hours before departure: Full reimbursement minus processing fees
  • 24-72 hours before departure: Refund of 50%
  • Less than 24 hours before departure: No reimbursement provided

5.2 Weather Cancellations

If our captain deems weather conditions unsafe, we offer to:

  • Move your charter to an alternate date at no extra cost
  • Issue a full refund if rescheduling is not feasible

5.3 Mechanical Issues

In case your assigned yacht encounters mechanical difficulties, we will strive to supply an appropriate replacement. Should a substitute not be available, we will issue a complete refund.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

  • Adhere to all instructions from the crew
  • Wear required safety gear when mandated
  • Disclose any medical conditions that may impact safety
  • Stay within the designated areas on the vessel

6.2 Prohibited Items

The following items are not allowed on board:

  • Glass containers
  • Illegal substances
  • Weapons or firearms
  • Excessive alcohol (beyond reasonable consumption)
  • Pets (unless pre-arranged)

6.3 Conduct

Guests are expected to behave respectfully. Should passenger conduct become unsafe or interruptive to others, we reserve the right to end the charter early with no refund.

7. Liability and Insurance

7.1 Our Liability

We limit our accountability to the cost of your charter. We are not accountable for:

  • Injuries sustained due to passenger carelessness
  • Loss or damage to personal belongings
  • Indirect, incidental, or punitive damages
  • Delays due to weather or events beyond our command

7.2 Insurance Coverage

Comprehensive marine insurance is maintained, covering our fleet and operations. It is up to passengers to ensure their personal and travel insurance coverage.

7.3 Assumption of Risk

By engaging in our charters, you accept that maritime activities pose inherent risks, and you take responsibility for your own safety and well-being.

8. Modifications and Itinerary Changes

We reserve the right to alter itineraries, routes, or timetables subject to climatic conditions, safety reasons, or operational necessities. We aim to provide alternative options of similar quality.

9. Force Majeure

We bear no liability for interruptions, cancellations, or alterations owing to events outside of our control, which include, but are not confined to:

  • Harsh weather scenarios
  • Natural catastrophes
  • Regulatory provisions
  • Harbor shutdowns
  • Vessel malfunctions

10. Privacy and Data Protection

We manage your personal data according to our Privacy Policy. By utilizing our services, you agree to the collection and use of your information as outlined in our Privacy Policy.

11. Intellectual Property

Our website content, encompassing text, imagery, brands, and logos, is secured by copyright and trademark regulations. Unauthorized reproduction, dissemination, or derivative creation is not permitted without our express permission.

12. Governing Law

The applicable laws of Spain govern these Terms. Any disputes are to be settled in the courts of Barcelona, Spain.

13. Changes to Terms
